Terms of service
These terms cover your business's use of BeeBeezy, the job management app for trade businesses. They're written to be read. If anything is unclear, email hello@beebeezy.com.
1. Who we are
BeeBeezy is a trading name of Marthus Johan Meyer (MJ Meyer), a sole trader in Aotearoa New Zealand (“we”, “us”). You can contact us at hello@beebeezy.com or by post at 29 Edward Abell Street, Milldale, Auckland 0932.
2. Who these terms are for
BeeBeezy is a tool for running a business. By creating an account or using BeeBeezy you agree to these terms on behalf of your business, and you confirm you're allowed to do that. “You” means that business and the people it invites to use BeeBeezy.
3. What BeeBeezy does
BeeBeezy helps trade businesses manage enquiries, quotes, jobs, scheduling, time and materials, invoices and payments, with an office app on the web and a field app on phones. We're still building it. Features can change, and some features (such as Tap to Pay) are marked as coming soon until they're ready.
4. Your account
- Keep sign-in details safe and tell us straight away if you think someone else has used them.
- You decide who in your business can use BeeBeezy and what they can see.
- You're responsible for what happens under your account.
5. Plans, prices and billing
- BeeBeezy is charged per person who uses it, per month, at the price shown on our pricing when you sign up. The standard price is $49 per person per month. Founding members pay $25 instead and keep that price for as long as their subscription stays active.
- Subscriptions are billed monthly in advance through Stripe and renew automatically until you cancel.
- We are not registered for GST, so no GST is charged on BeeBeezy subscriptions. If that changes we'll tell you before it affects your price.
- We'll give you at least 30 days' notice by email before any price change applies to you.
- If a payment fails, we'll let you know. If it isn't sorted within 14 days we may pause your account until it is.
6. Taking payments from your customers
If you take card payments from your customers through BeeBeezy, those payments go to your own Stripe account, under Stripe's terms between you and Stripe. You are the seller to your customers: you set your prices, and you handle refunds, disputes and chargebacks with them and Stripe. BeeBeezy does not hold your customers' money and does not add a platform fee. Stripe's processing fees are charged by Stripe.
7. Your data
- Everything your business puts into BeeBeezy, including your customers' details, stays yours. We use it only to run BeeBeezy for you, to keep it secure, and as our privacy policy describes.
- You're responsible for having the right to put your customers' information into BeeBeezy and for using it in line with the Privacy Act 2020.
- You can ask for an export of your data at any time. After you cancel, we keep your data for 90 days so you can come back or take a copy, then delete it, except where the law requires us to keep something longer.
8. Connected services
BeeBeezy can connect to other services, such as Xero and Stripe. Their own terms apply to your use of them, and we aren't responsible for them. You can disconnect them at any time.
9. Fair use
Don't use BeeBeezy to break the law, send spam, or harm other people or our systems. Don't try to get around security, or copy or resell BeeBeezy.
10. Availability and support
We work hard to keep BeeBeezy available and your data safe, and we back it up. But no online service is perfect, and there may be planned maintenance or outages we can't control. Email hello@beebeezy.com for help.
11. Cancelling
You can cancel any time from your account settings or by emailing us. Your subscription stays active until the end of the month you've paid for, then stops. See our refund policy. We may close an account that seriously or repeatedly breaks these terms, and we'll tell you why.
12. Business use and the law
BeeBeezy is supplied for business purposes. To the extent the law allows, you and we agree that the Consumer Guarantees Act 1993 does not apply, and that sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, because we are both in trade. Nothing in these terms limits rights that can't be excluded by law.
13. Liability
To the extent the law allows, we're not liable for indirect losses such as lost profits or lost data, and our total liability to you for any claim is limited to the subscription fees you paid us in the 12 months before the claim. This doesn't apply to losses caused by our fraud or wilful misconduct.
14. Changes to these terms
If we change these terms in a way that matters, we'll email you at least 30 days before the change applies. Continuing to use BeeBeezy after that means you accept the new terms.
15. New Zealand law
These terms are governed by New Zealand law, and New Zealand courts have jurisdiction.
